Sec. 6A. - A-3 Residence District uses: townhouses, apartments, condominiums.#

(a) Statement of purpose and intent.

The primary purpose of the A-3 Residence District is to provide for the maximum utilization of available land in the Town with appropriate safeguards for the protection of surrounding districts. The construction of townhouses, apartments, and condominiums shall be included in this district.

Within any A-3 Residence District, as the boundaries of said districts are described in this Code or as shown on the Building Zone Map of Chatham, Virginia, no lot, building, or structure shall be erected which is intended or designed to be used, in whole or in part, for any industrial manufacturing, trade, or commercial purpose, or for any other than the following specified purposes:

A building or buildings, commonly known as apartment house or houses, town or row houses, used or intended to be used as a place of abode of three or more families living independently of each other.

Sec. 6B. - A-3 Residence District regulations.#

(a) Final plat.

As a condition precedent to the issuance of the building permit for the construction of any A-3 residential zone, a final plat to scale of the perimeter, indicating the location of the improvements, parking area, garbage disposal, height and construction plans, shall be submitted to the Town Engineer or Director of Public Works for approval.§

(b) Public utilities.

Before issuance of a building permit for any construction contemplated by this section, the owner or owners of the real estate affected shall execute and deliver to the town, or its assignee, an easement for public utilities not less than five feet in width, contiguous to the perimeter of the lot or lots.§

(c) Special permits.

Any special permit required pursuant to this section shall be issued only after public hearing upon conditions as set forth in the Code of Virginia for public hearings. The special permit shall be issued only by order of the Council upon a report of the Board of Zoning Appeals or any successor body thereto.

Sec. 6C. - A-3 Residence District area requirements.#

(a) Yards.

The minimum setback line from the street or road right of way of any structure in any A-3 Residence District shall be 35 feet. The minimum required side yard for any main structure in any A-3 Residence District shall be ten feet. The minimum required rear yard for any main structure in any A-3 Residence District shall be ten feet. The minimum required side and rear setback lines shall be increased ten feet for each ten feet of height of any structure in excess of three stories from grade level.§

(b) Height of buildings.

For any building or buildings constructed pursuant to this section, none shall be greater than three stories from grade except by the issuance of a special permit§ in the manner hereinafter provided, where the contemplated construction is in excess of three stories.

(c) Floorspace.

Each lot or combination thereof upon which a building or buildings as set forth in Section 6A above shall be built, shall contain a minimum of 1,500 square feet for each one bedroom dwelling unit§, and 2,000 square feet for each two bedroom or greater dwelling unit§, with a minimum lot size for any such building or complex authorized by this zoning section of 6,000 square feet.

Sec. 6D. - A-3 Residence District parking—off-street.#

For every such building or buildings constructed in said zone, the builder or owner thereof shall provide vehicular parking space for standard size automobiles at the rate of one and one-half parking spaces for each separate dwelling unit. It is further provided that all ingress and egress for vehicular traffic shall be so designed, arranged and constructed as to allow moving vehicles to leave and enter public streets or highways in a forward direction and no such parking facilities shall be designed whereby direct access to a public way shall be had by backing into said public way.§
